Art. 178

Net taxable income (*renta líquida*) consists of gross income less deductions that bear a causal relationship to income-producing activities.

Net taxable income is taxable income, and the applicable rates apply to it, except where exempt income exists, in which case the exempt income is subtracted to determine taxable income.

Colombian term of art. The statute uses renta líquida as the base after deductions but before exempt-income adjustments. U.S. lawyers may conflate this with 'taxable income' (which the statute reserves for renta gravable, the final base). Keep the Spanish gloss on first use in a title or section to preserve the Colombian calculation sequence: renta bruta → renta líquida → renta gravable.

Canonical U.S. tax term. Colombian renta bruta is gross income before deductions, analogous to IRC § 61 gross income, though the Colombian schedular system differs.

U.K./OECD: deductions with a causal connection

Colombian causality test for deductions. Not identical to U.S. 'ordinary and necessary' (IRC § 162) or U.K. 'wholly and exclusively'. The DIAN and courts apply a nexus standard: the expense must relate to income production. Do not import U.S. doctrines (e.g., Cohan rule, capitalization) unless the Colombian statute or regulation explicitly adopts them.

Statutory exemptions listed elsewhere in the Estatuto (e.g., arts. 206 et seq.). Not exclusions from gross income; these are items included in renta líquida then subtracted to reach renta gravable. The Colombian structure differs from U.S. exclusions (IRC § 101–140), which never enter gross income.

U.K./OECD: chargeable income

The final tax base to which rates apply. In the Colombian calculation: gross income − deductions = net taxable income (renta líquida); net taxable income − exempt income = taxable income (renta gravable).

Tax rates (percentages). The Estatuto sets rates by taxpayer type and income schedule (e.g., arts. 240, 241). Not 'tariffs' (customs duties).
